Terms of Service

1. The Service

ProvenShot lets you create verifiable proofs of photos and videos: each proof records the time and GPS location of capture, plus a cryptographic fingerprint of the content. Anyone can verify a proof through our public verifier. The Service is operated by [ProvenShot legal entity name], with registered address at [address], Spain, tax ID [CIF/NIF].

2. Eligibility

You must be at least 16 years old to create an account. By using the Service, you confirm you have the legal capacity to enter into these Terms.

3. Account and registration

• You are responsible for the accuracy of the information you provide.
• You are responsible for keeping your password and account credentials secure.
• You must not share your account or impersonate someone else.
• We may suspend or terminate accounts that breach these Terms.

4. Subscriptions, plans and packs

• The Service offers a free plan, monthly subscriptions ("Plans") and one-time purchases ("Packs").
• Payments are processed by Stripe. Prices are in Euros and include VAT where applicable.
• Subscriptions renew automatically until cancelled. You may cancel from your account at any time.
• Refund policy: cancellations stop future renewals; we do not refund partial billing periods, except where required by law (EU consumer right of withdrawal: 14 days from purchase, unless the service has already been provided with your consent).
• Pack proofs do not expire.
• We may change prices with reasonable notice.

5. Your content and proofs

• You retain all rights in the content you capture.
• By using the Service, you grant us a limited licence to store, process and display the metadata associated with your proofs (timestamp, location, fingerprint) so that the Service can function.
• You are responsible for the legality of the content you capture and share. Do not capture content that infringes the rights of others, contains illegal material, or that you do not have the right to record.

6. Acceptable use

You agree not to:

• Use the Service for unlawful purposes.
• Attempt to manipulate, forge or tamper with proofs or verification results.
• Reverse engineer, scrape or interfere with the Service.
• Resell access to the Service without our written agreement.
• Use the Service to harass, harm or stalk others.

7. Verification feature

Proofs and verification results are technical evidence of when, where and what was captured through ProvenShot. They are not, by themselves, conclusive legal evidence. We make no warranty that any third party will accept a ProvenShot proof for any specific purpose.

8. Intellectual property

The Service, including its design, code, trademarks and content (excluding user content), is owned by us or our licensors and is protected by intellectual property law. You receive a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

9. Termination

• You may close your account at any time.
• We may suspend or terminate your access if you breach these Terms or for legitimate reasons (security, legal, prolonged inactivity).
• Sections that should survive termination (IP, liability, governing law) will do so.

10. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free or secure against every threat.

11. Limitation of liability

To the extent permitted by law, our total liability for any claim arising out of or in connection with the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, consequential, special or punitive damages.

12. Indemnification

You agree to indemnify us against any claim arising from your use of the Service, your content or your breach of these Terms, except where prohibited by law.

13. Changes

We may update these Terms. The updated version will be posted here with a new "Last updated" date. Material changes will be notified to you. Continued use after changes constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by Spanish law. Disputes will be submitted to the courts of [city], Spain, except where mandatory consumer protection rules grant you the right to bring claims in your country of residence.
